These Terms and Conditions ("Terms") govern your use of the website located at www.drdripplumbing.com (the "Site") and your participation in the Dr. Drip Plumbing and Heating SMS Messaging Service (the "Program"), operated by Dr. Drip Home Services, doing business as Dr. Drip Plumbing and Heating ("Dr. Drip," "we," "us," or "our"). By using the Site or opting in to the Program, you agree to these Terms. If you do not agree, do not use the Site or opt in to the Program.

SMS Messaging Terms

1. Program Name

The name of our text messaging program is the Dr. Drip Plumbing and Heating SMS Messaging Service. Messages are sent by Dr. Drip Home Services, DBA Dr. Drip Plumbing and Heating.

2. Program Description

By opting in to the Dr. Drip Plumbing and Heating SMS Messaging Service, you agree to receive recurring automated text messages from Dr. Drip Plumbing and Heating at the mobile number you provided. The Program includes the following message types, each of which requires its own separate consent:

• Appointment and service messages: appointment confirmations and reminders, scheduling and rescheduling notices, technician arrival notices, service updates, estimates, invoices, job completion summaries, and responses to your customer support requests.
• Marketing messages (optional): offers, discounts, coupons, seasonal maintenance reminders, and membership promotions. You will only receive marketing messages if you separately opt in to them.

You can opt in by checking the SMS consent checkbox(es) on our website forms, or by providing express consent verbally or in writing when you contact us by phone or in person. Consent checkboxes are never pre-checked. Consent to receive text messages is not a condition of any purchase.

3. Message and Data Rates

Message and data rates may apply. Dr. Drip does not charge for Program messages, but your mobile carrier's standard message and data rates may apply to messages you send and receive. Contact your wireless carrier for details about your plan.

4. Message Frequency

Message frequency varies. Appointment and service messages are sent based on your scheduled appointments and service activity, typically up to 10 messages per service visit. If you opt in to marketing messages, you will receive up to 4 marketing messages per month.

5. Opting Out (STOP)

You can cancel the SMS service at any time. Reply STOP to opt out. You may also reply QUIT, CANCEL, END, OPT OUT, STOPALL, or UNSUBSCRIBE. After you send STOP, we will send you one final message confirming that you have been unsubscribed, and you will no longer receive text messages from us. To rejoin, sign up again as you did originally or reply START, and we will resume sending messages to you.

6. Help (HELP)

Reply HELP for help. If you are having trouble with the Program, reply HELP to any message for assistance, or contact us directly using the customer support information below.

8. Carrier Liability

Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your wireless service provider and network availability. Neither Dr. Drip nor any wireless carrier is responsible for messages that are delayed, not delivered, or misdirected.

9. Privacy Policy

Your privacy matters to us. For information about how we collect, use, and protect your information, see our Privacy Policy: https://www.drdripplumbing.com/privacy-policy/. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.

10. Eligibility and Your Number

You must be at least 18 years old, and the account holder or authorized user of the mobile number you provide, to participate in the Program. If you change or deactivate your mobile number, you agree to reply STOP from that number beforehand or to notify us promptly so we do not send messages to its new owner.

Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site in any way that could damage, disable, or impair it, or to attempt to gain unauthorized access to any part of it.

Service Information, Pricing, and Coupons

Information on the Site about our plumbing and heating services is provided for general informational purposes and does not constitute a quote. Actual pricing is determined after an on-site assessment. Coupons and promotional offers are subject to the terms and expiration dates stated on each offer, may not be combined unless stated, and may be modified or withdrawn at any time. Online scheduling requests are not confirmed until we confirm them with you.

Intellectual Property

The Site and its content, including text, graphics, logos, and images, are owned by or licensed to Dr. Drip and are protected by copyright, trademark, and other laws. You may not copy, reproduce, or distribute any content without our prior written permission.

Third-Party Links

The Site may contain links to third-party websites. We do not control and are not responsible for the content or practices of those websites.

Disclaimer of Warranties

THE SITE AND THE PROGRAM ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DR. Nothing in these Terms limits any warranty we provide in writing for work performed at your property, or any rights you have under applicable law that cannot be waived.

Indemnification

You agree to indemnify and hold Dr. Drip harmless from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Site or the Program.

Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law principles. Any dispute arising from these Terms will be resolved in the state or federal courts located in Bergen County, New Jersey.

Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on this page, and the effective date above will be updated. Your continued use of the Site or the Program after changes are posted means you accept the updated Terms.
